Conroe, January 7 – Corrupt local political boss Marc Davenport, already under criminal indictment for allegedly violating the Texas Open Meetings Act, made numerous admissions about the Phonoscope Enterprise Group scandal overwhelming the Montgomery County government in a communication he made on Friday, January 5, 2018, to which The Golden Hammer, Montgomery County’s leading daily newspaper received access. It’s apparent that Davenport has far too much control over County decisions when he is not a County employee. It’s also questionable whether Davenport, County Judge Craig Doyal, Precinct 2 County Commissioner Charlie Riley, Sheriff Rand Henderson, and County Treasurer Stephanne Davenport have violated the Texas Open Meetings Act by conspiring to circumvent the Act in their secret meetings and deliberations concerning Phonoscope.

Here’s a brief summary of the Phonoscope scheme:

In return for enormous payments from Phonoscope CEO Lee Cook to Montgomery County Treasurer Stephanne Davenport and Sheriff Rand Henderson, local political boss Marc Davenport (the Treasurer’s husband) ordered County Judge Craig Doyal and the County Information Technology Department to assist with the installation of Phonoscope’s deep fiber optic cable system throughout County government facilities. The County Commissioners Court never approved any contractual terms or pricing with Phonoscope and never approved installation of Phonoscope fiber optic cable anywhere and certainly not inside County buildings or rights-of-way.

One of the benefits to the Phonoscope scheme is that Phonoscope would use the County fiber optic cable system as a trunkline off of which Phonoscope, through a local distributor, could sell services to private real estate developers, municipalities, and homeowners associations. Therefore, Davenport sought investors for the local distribution scheme.

One thing is clear: Marc Davenport, Craig Doyal, Charlie Riley, Rand Henderson, and Stephanne Davenport, all with ties to the Davenport Ring of corrupt officials, are proceeding with Phonoscope’s deep fiber optic cable installation throughout Montgomery County without Commissioners Court approval of an sort of contractual terms and without any authority other than their usurpation of power.

The following is Davenport’s communication, dated January 5, in its entirety. An annotated version follows.

Marc Davenport: “I spell my name Marc, you are incorrect in your premise, I learn from Mark W Shorten as do many do who read the research that he does. Unlike others, he researches the displays documents that provide the credibility, he names his sources. Sherrie and Jessica do proper news stories and the electeds are prone to respond to them. This post is about lies. I have had little contact with you except at the polls so we should have no charge against each other. Lets start with the latest fantasy. Phonoscope, you think you know something about it. If you do GH is your only source. I have no financial interest in Phonoscope, the owner is a supporter of Rand Henderson and Stephanne Davenport. Lee Cook is the sole owner of 100’s of thousands of high speed fiber miles in the region. They operate the largest close network in the country. They are a public utility company, which explains why they do not need to petition for access to right-of-way. My only meeting with IT in the last 2 years was a transition meeting I attended with Rand Henderson. We brought up Phonoscope and IT said they knew all about them, but could never access their network. Rand informed them that they would be after he took office. They are many places that the county government needed diverse routes to facilities where Phonoscope was on the pole outside. The famous article about PCT4 calling the publisher instead of IT. Is a classic example. Mark Ruenes from IT was with them on the site survey. Which is nothing more then to see what it will take to get from the pole to the building. They tagged both ends of a string and moved on while the publisher raced to the scene. Clark can do what he wants he has 359 days left. But others want it, they are going to get it. The network is here, the county is just tapping in and saving a ton of money thanks to Rand Henderson. Eric and I had lunch in the spring, knowing the tremendous market that there would be for 400 channels and 1 gig up/down constant internet for $200mo,. I told him it would be a smart move for investors to set up REIT or similar devise to finance and own the client base in the under served areas. Knowing the Riley, Henderson, Doyal, could claim success in establishing the relationship. GH wants to pounding it, to take that away. I have no interest, nor does Doyal. They have been here for decades, just opening their services to others because of new relationships.”

The following is an annotated explanation of Davenport’s communication.

Davenport is all about propaganda. He’s recruited Mark Shorten and Sherrie Shorten, who recently got out of federal prison for felony fraud convictions after they stole money from Hurricane Katrina victims. When they went to prison, they abandoned their children, who literally starved until they were placed in foster homes, while they went to prison. Numerous local media outlets reported how local law enforcement found the Shortens’ children starving and filthy living in the school bus in East Montgomery County while the Shortens served federal prison time.

Shorten does little more than write personal insults with no substantive content. His wife and daughter do little more than try to rebut The Golden Hammer while working directly with the politicians in the corrupt Davenport Ring – Wayne Mack, JP James Metts, embattled County Treasurer Stephanne Davenport, Sheriff Rand Henderson, Constable Rowdy Hayden, JP4 candidate Jason Dunn, and District Clerk candidate Cynthia Jamieson – who feed them information.

How can Davenport not have a financial interest in Phonoscope when Phonoscope’s CEO Lee Cook is a major financial contributor to Davenport’s wife’s political campaign?!

This portion of Davenport’s tome is an important admission, because it draws his wife, County Treasurer Stephanne Davenport, directly into the Phonoscope scandal for the first time. Cook, who is Phonoscope’s CEO and owner, told The Golden Hammer that he met with both 2016 candidates for Montgomery County Sheriff with the idea that he wanted to have influence with the winner. The meeting with Montgomery Police Chief Jim Napolitano didn’t go as well as Cook’s meeting with Henderson, because Marc Davenport and Rand Henderson became very upset when they discovered Cook intended to meet with Napolitano at all. It’s important to note that Cook hasn’t paid enormous contributions to members of the Commissioners Court, because the Davenport-Phonoscope plan is to circumvent the authority of the Montgomery County Commissioners Court, which has the sole legal authority to approve a plan to install fiber optic cable inside all of the County buildings and properties. The only mention of any sort of approval by the Commissioners Court occurred when Doyal and Davenport tucked a purchase order totaling $0.00 for Phonoscope products and services in the “consent agenda” for the January 24, 2017, meeting. That purchase order contained no pricing, no terms, no conditions, and no authority to install cable in County facilities. To this date, there is no Commissioners Court approval, as Phonoscope’s Lee Cook and County officials were well aware as of June 7, 2017. Interestingly, there is a direct competitor of Phonoscope which is based in Montgomery County, a company named Wavemedia, which has done business with several local school districts and has done some business with the Montgomery County government.

When the County Information Technology Department tried to allow Wavemedia, a local company, to do the fiber optic cable installation and placed that intention on the Commissioners Court agenda, Marc Davenport saw the draft agenda (improperly because he’s not a County employee and should not have been among those who receive the draft) and then instructed County Judge Craig Doyal and Doyal’s “chief of staff” jim fredricks to remove the Wavemedia item from the agenda. Doyal and fredricks met with Information Technology Director Marshall Shirley and his assistant and gave them “Hades” for putting the Wavemedia approval on the agenda without getting permission from Marc Davenport first. Please see “Montgomery County Government ‘For Sale’ (Part 11): Marc Davenport’s In Charge,” December 5, 2017.

It’s a clear example of improper direction and control over the County government by the corrupt Davenport Ring.

Why would a non-County employee who is just a public relations consultant to the Sheriff-Elect have a meeting at all with the Information Technology Department about installation of an entire fiber optic cable system?

Without face-to-face meetings, Marc Davenport has directed the IT Department’s implementation of the Phonoscope fiber optic cable system, as numerous IT Department employees have confirmed. Please see “Montgomery County Government ‘For Sale’ (Part 11): Marc Davenport’s In Charge,” December 5, 2017.

A more significant question is: why in the world would the Sheriff-Elect have the authority to direct the installation of a fiber optic network in County government facilities without getting Commissioners Court approval of the pricing and the contractual terms and conditions?!

If Davenport has such little involvement in the Phonoscope installation, how does he have such intimate knowledge of it all?!

This section of the Davenport communication is factually incorrect. The “famous article” to which Davenport referred is “Montgomery County Government ‘For Sale’ Part 6: Why It’s So Important To The Davenport Ring To Get Rid Of Commissioner Jim Clark (And Bagley Too),” The Golden Hammer, October 24, 2017.

What actually happened was that Phonoscope came into Commissioner Jim Clark’s Precinct 4 Office without his approval by lying to the receptionist that they were merely there to perform a “survey.” What they did instead was to run a line through the conduit pipe and tag it at both ends with a Phonoscope label. A line remained in the conduit pipe in order to pull the deep fiber optic cable through under the surface of the ground. Then Phonoscope painted the grass in front of Commissioner Clark’s Office red with red flags inserted into the ground where they were going to install the fiber optic cable lines without the Commissioner’s approval or authority. Clark instructed his employees to remove the flags and mow the grass to remove the red paint after he discovered Phonoscope’s unauthorized plan.

Once again, why are a non-County employee, Marc Davenport, and the County Sheriff directing a network cable installation in a non-law enforcement County facility, when they have no authority from the Commissioners Court?

“Clark can do what he wants he has 359 days left. But others want it, they are going to get it. The network is here, the county is just tapping in and saving a ton of money thanks to Rand Henderson.”

This statement in Davenport’s tome is an example of the manner in which the Davenport Ring threatens officials whom the citizens have elected, because those officials won’t cooperate with the Davenport Ring’s corruption.

Davenport further has stated “the network is here” but it’s here because Davenport and Henderson have installed the network in County facilities without permission or authority.

Davenport admitted that he solicited an investment from the Publisher of The Golden Hammer into the Phonoscope fiber optic cable system! If that’s not corruption, what is?

The Publisher of The Golden Hammer had a simple response: “If I’m trying to clean up Montgomery County government corruption, how would that work if I choose to become a part of the corruption by profiting off of the County government? The answer is ‘No.'” (It turns out Davenport solicited substantial investments into the corrupt scheme from others as well who turned the political boss down for the same reason.)

How in the world is that not a conspiracy to circumvent the open meetings and open deliberations requirements of the Texas Open Meetings Act? Riley, Henderson, Doyal, Davenport, and apparently Stephanne Davenport are making decisions where to install fiber optic cable systems without any approval from the Commissioners Court for those installations.
